# EULA - End User License Agreement

## 1. Acceptance of Terms

By downloading, installing, or using the BlindDrink application ("App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to these terms, do not use the App.

## 2. License Grant

PelliCan Labs grants you a limited, non-exclusive, non-transferable, and revocable license to:
- Download and install the App on your mobile device
- Use the App for personal, non-commercial purposes
- Access and use the App's features according to these terms

## 3. Usage Restrictions

**You MAY NOT:**
- Modify, decompile, disassemble, or reverse engineer the App
- Remove, alter, or obscure copyright notices, trademarks, or proprietary rights notices
- Sell, rent, lease, lend, or distribute the App
- Use the App for illegal or unauthorized purposes
- Attempt to gain unauthorized access to servers or networks
- Upload offensive, defamatory, or illegal content
- Use bots, scripts, or automated tools to manipulate the game
- Impersonate other users or falsify your identity

## 4. Intellectual Property

All rights, titles, and interests in the App, including but not limited to:
- Source and object code
- Design, graphics, and visual elements
- Trademarks and logos
- Content and databases

remain the exclusive property of PelliCan Labs. This EULA does not grant you any ownership rights.

## 5. User-Generated Content

### 5.1 Ownership
You retain ownership of photos, notes, and other content you upload ("User Content").

### 5.2 License to PelliCan Labs
By uploading User Content, you grant PelliCan Labs a worldwide, non-exclusive, royalty-free license to:
- Store and display your content in the App
- Share it with other players in your games
- Use it to improve our services

### 5.3 Responsibility
You are responsible for ensuring that your User Content:
- Does not violate third-party rights
- Does not contain illegal or offensive material
- Complies with all applicable laws

## 6. User Account

### 6.1 Account Creation
You must provide accurate and complete information during registration.

### 6.2 Account Security
You are responsible for:
- Keeping your password confidential
- All activities that occur under your account
- Immediately notifying us of any unauthorized use

### 6.3 Suspension and Termination
We reserve the right to suspend or terminate your account if you:
- Violate this EULA
- Use the App fraudulently or abusively
- Do not respect community rules

## 7. In-App Purchases and Payments

BlindDrink is currently free. If we introduce in-app purchases or subscriptions in the future, we will notify you and require acceptance of additional terms.

## 8. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Continuous and uninterrupted availability
- Error-free or bug-free operation

## 9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PELLICAN LABS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or opportunities
- Service interruptions or loss of access
- Damages arising from use or inability to use the App

Total liability shall not exceed the amount paid for the App (if applicable).

## 10. Updates and Modifications

### 10.1 App Updates
We may release updates, patches, or new versions. Updates may:
- Add new features
- Fix bugs
- Modify existing features
- Require acceptance of updated terms

### 10.2 EULA Modifications
We reserve the right to modify this EULA. Significant changes will be notified via:
- In-app notification
- Email
- Updated "Last Updated" date

Continued use after changes constitutes acceptance.

## 11. Dispute Resolution

### 11.1 Governing Law
This EULA is governed by Italian law, without regard to conflict of law provisions.

### 11.2 Jurisdiction
Any disputes shall be subject to the exclusive jurisdiction of competent Italian courts.

### 11.3 Amicable Resolution
Before initiating legal proceedings, parties agree to attempt amicable resolution by contacting blinddrink.support@gmail.com.

## 12. General Provisions

### 12.1 Entire Agreement
This EULA constitutes the entire agreement between you and PelliCan Labs regarding the use of the App.

### 12.2 Severability
If any provision is deemed invalid, other provisions remain in effect.

### 12.3 Waiver
Failure to exercise a right does not constitute a waiver of that right.

### 12.4 Assignment
You cannot transfer or assign your rights under this EULA. PelliCan Labs may assign this agreement without restrictions.

## 13. Termination

### 13.1 Termination by You
You may terminate this agreement at any time by:
- Deleting your account
- Uninstalling the App from all devices

### 13.2 Termination by Us
We may terminate this agreement immediately if:
- You violate the terms of this EULA
- The App is discontinued or replaced
- Required by law

### 13.3 Effects of Termination
Upon termination:
- Your license to use terminates immediately
- You must uninstall the App
- We may delete your data according to the Privacy Policy
